KUPPET Asks Macharia Refund House Levy for 460,000 Teachers

Kenya Union of Post Primary Education Teachers KUPPET has given the Teachers Service Commission (TSC)  a period of 14 days to refund the house levy deductions for teachers or face legal action.

According to Kuppet, the deductions are illegal as TSC portray disobedience of court orders .

While addressing the media, the Kuppet acting secretary general Moses Nthurima said that there is no reason that the commission can deduct teacher’s money without a legal foundation.

Nthurima added that high courts have so far issued orders currently in the public domain and for that, TSC  can’t claim that  they don’t know the orders and for that reason, they have to return the money.

TSC has now been asked to refund all the deducted money after it emerged that the over 406,000 teachers’ payroll suffered housing levy deductions in their February salaries.

Teachers have been deducted despite the levy being declared illegal by the court.

The union of Post primary teachers have  now threatened to take legal action against the employer.

The union announced this  after it learned that TSC has failed to refund January house levy and also went a head to  deducted house levy on teachers February salaries.

While addressing the media lat week, TSC chief executive Nancy Macharia said that the January deductions were effected before the court order were released.

Macharia told the media that the  ruling on housing levy came after salaries had been process and teachers had paid the salaries.

Macharia noted that TSC payroll on 20th of every month and the ruling  was issued on  the 26th, January 2024.

In the fresh demand, now Kuppet wants a refund of all housing levy deductions backdated to July last year when it started.

Details indicate that  highest paid teacher earning a maximum basic salary of Sh131,380 is deducted about sh6,000 per month.

KUPPET has now  questioned TSC’s excuse for making deductions this month despite the court order.

Last month , TSC had indicated its plan to refund  the deductions following an official agreement with the union.
